Running a confidential misconduct investigation to address serious workplace behaviour and patient safety concerns
OCM was engaged to investigate allegations of long-term misconduct enacted by employees of a health sector facility. These allegations related to sexual harassment, physical violence, bullying and harassment between staff. The facility also raised concern about discrimination and favouritism in internal recruitment, as well as risk to patient safety due to the behaviour of staff in the facility.

Understanding not only individual conduct but the systems, controls and cultural factors influencing poor behaviour
The nature and breadth of the allegations indicated possible systemic issues, including gaps in oversight, inconsistent application of policies, and a workplace culture that may have enabled inappropriate behaviours to persist. Given the seriousness of the matters, the agency required an independent and confidential investigation to establish the facts, assess the validity of the allegations, and provide clear, defensible findings to support appropriate action.
OCM conducted a comprehensive and confidential investigation in accordance with the requirements of the Public Interest Disclosure framework. Our approach was structured, evidence-based, and designed to ensure procedural fairness for all parties involved.
We undertook extensive stakeholder engagement, conducting interviews with more than 70 employees to capture firsthand accounts, identify patterns of behaviour, and test the consistency of evidence. This was supported by a detailed review of documentation, including medical records, staff rosters, training materials, clinical procedures, and relevant correspondence.
In response to the seriousness of patient safety concerns, OCM also liaised with relevant state-based regulatory bodies, including law enforcement agencies, to ensure appropriate escalation and coordination.
Results that matter
Addressing systemic and organisational issues to rebuild trust and drive lasting change
OCM delivered a comprehensive investigation report that provided clear, evidence-based findings across a broad range of historical and contemporary allegations. Particularised allegations of misconduct were formally developed and put to nine current and former employees, ensuring procedural fairness and enabling the agency to take informed and defensible action.
The investigation also identified a range of systemic and organisational issues, including weaknesses in recruitment practices, inconsistent application of policies, and gaps in oversight and supervision.
Practical, tailored recommendations were provided to address these issues, supporting the agency to strengthen governance arrangements, enhance workforce practices, and improve patient safety outcomes. As a result, the facility was better positioned to manage conduct risks, drive cultural change, and rebuild trust with staff and stakeholders.
